Third-party complaint alleged that Shuhab defendants, along with third-party defendant Department of Housing Preservation and Development (HPD) conspired together to induce residents to purchase units by making knowingly false representations about their intention to complete renovation work. The residents took out loans and HPD diverted funds and left residents with an uninhabitable building. The court affirmed denial of third party defendants motion to dismiss third party causes of action for fraud and conspiracy to commit fraud.
