Jared E. Paioff is a partner of the firm and a seasoned litigator whose practice areas primarily include real estate and general business litigation. His extensive real estate litigation experience (at trial and appellate levels) covers a broad range of real estate-related matters, such as construction defects in residential condominiums, real property contract disputes, trespass and air rights disputes, violations of commercial leases, director and officer liability issues, and breaches of AIA and construction agreements. Mr. Paioff provides general counseling to the boards and managing agents of the firm’s cooperative and condominium clients, and defends and prosecutes actions on their behalves concerning anything from transient occupancy and subletting issues to alteration and property damage disputes with unit owners, tenants, sponsors, and neighboring buildings. Mr. Paioff also counsels owners, operators, and developers of multi-family and residential condominium properties in a wide range of transactions and in all facets of litigation and alternative dispute resolution.
Mr. Paioff’s commercial practice encompasses all aspects of business litigation on behalf of corporations, LLCs, partnerships, and individuals. He has represented the firm’s clients in matters involving disputes over commercial and advertising contracts, non-compete agreements, employment disputes, copyright infringement and theft of trade secret actions, bankruptcy proceedings, and commercial collection matters. Mr. Paioff also specializes in counseling and litigating on behalf of startups and other technology companies.
In 2015, 2016, and 2017, Mr. Paioff was named a Rising Star by New York Super Lawyers in the areas of real estate law and business litigation. He also has been quoted in multiple news publications, including The New York Times, The Real Deal, and Habitat Magazine. Mr. Paioff co-authored the article Protecting Board Members from Personal Liability, Mann Report, September 2012.
Mr. Paioff’s reported Appellate Court decisions include San-Dar Associates v. Fried, affirming denial of plaintiff’s summary judgment motion on air rights encroachment claim; Board of Managers of The South Star v. WSA Equities, LLC, permitting fraudulent misrepresentation claim against sponsor/developer and its principals; Baxter Street Condominium v. LPS Baxter Holdings, affirming plaintiff’s motion for summary judgment against developer on Business Judgment Rule grounds; Board of Managers of The South Star v. Grishanova, affirming order of contempt against unit owner for violating court order enjoining her from renting her condominium unit to transient tenants; 110 Cent. Park S. Corp. v. Board of Managers of 116 Cent. Park S. Condo., affirming denial of plaintiff’s summary judgment motion seeking removal of defendant’s chimney flue on plaintiff’s building; Weinreb v. 37 Apartments Corp., reversing denial of motion to dismiss shareholders’ permanent injunction claim against directors of a coop board where only substantive claim against them had previously been dismissed.
Prior to joining the firm, Mr. Paioff was an associate at Wolf Haldenstein Adler Freeman & Herz LLP and also served as a law clerk to the Honorable Marcy S. Friedman, Commercial Division Justice of the New York Supreme Court for the County of New York. Most recently, he served as the Finance Chair to Justice Friedman’s campaign for re-election to the Civil Court for the City of New York.
Mr. Paioff graduated from The George Washington University (B.B.A., Finance, 2004) and from Fordham Law School (J.D., 2008). While at Fordham Law School, Mr. Paioff was a Staff Member of the Environmental Law Review and received the Archibald R. Murray Public Service Award cum laude for his participation in the Criminal Defense Clinic.
Mr. Paioff is admitted to the bar of the State of New York and the Federal District Court for the Southern District of New York. In his spare time, Mr. Paioff is active in various charitable organizations, including Cycle for Survival, the Anti-Defamation League, and the JCC of Manhattan.
