Jared E. Paioff is a partner of the firm and a seasoned litigator whose practice areas primarily include general commercial and real estate litigation. He provides general counseling to the boards and managing agents of the firm’s cooperative and condominium clients, and his extensive litigation experience (at trial and appellate levels) includes a broad range of real estate and general commercial matters, such as construction defects in residential condominiums, director and officer liability issues, unauthorized alterations, business and real property contract disputes, litigation over commercial lease transactions, broker commission disputes, transient occupancy and subletting issues, and disputes with unit owners, tenants, sponsors, and neighboring buildings, among others. Mr. Paioff also represents landowners and developers in cases concerning real property transactions.
In 2015 and 2016, Mr. Paioff was named a Rising Star by New York Super Lawyers in the areas of real estate law and business litigation. He co-authored the article Protecting Board Members from Personal Liability, Mann Report, September 2012. He also has been quoted in multiple real estate news publications, including The Real Deal article “Fort Greene condo board sues over missing CofO” and, more recently, the Habitat Magazine article entitled “Major Legal Win for Condo Boards.”
Mr. Paioff’s reported Appellate Court decisions include Weinreb v. 37 Apartments Corp., dismissing shareholders’ cause of action for permanent injunction against directors of residential cooperative corporation where only substantive claim against them had previously been dismissed; 110 Cent. Park S. Corp. v. Board of Managers of 116 Cent. Park S. Condo., affirming denial of plaintiff’s motion for summary judgment seeking an Order directing the removal of a chimney flue on plaintiff’s building; The Board of Managers of The South Star v. Grishanova, affirming order of contempt against unit owner for violating court order enjoining her from unlawfully renting her condominium unit to transient tenants; Baxter Street Condominium v. LPS Baxter Holdings, affirming plaintiff’s motion for summary judgment against developer on Business Judgment Rule grounds; Board of Managers of The South Star v. WSA Equities, LLC, permitting fraudulent misrepresentation claim against sponsor/developer and its principals.
Prior to joining the firm, Mr. Paioff was an associate at Wolf Haldenstein Adler Freeman & Herz LLP and also served as a law clerk to the Honorable Marcy S. Friedman, Commercial Division Justice of the New York Supreme Court for the County of New York. Most recently, he served as the Finance Chair to Justice Friedman’s campaign for re-election to the Civil Court for the City of New York.
Mr. Paioff graduated from The George Washington University (B.B.A., Finance, 2004) and from Fordham Law School (J.D., 2008). While at Fordham Law School, Mr. Paioff was a Staff Member of the Environmental Law Review and received the Archibald R. Murray Public Service Award cum laude for his participation in the Criminal Defense Clinic.
Mr. Paioff is admitted to the bar of the State of New York and the Federal District Court for the Southern District of New York. In his spare time, Mr. Paioff is active in various charitable organizations, such as Cycle for Survival, the Anti-Defamation League, and the JCC of Manhattan.
